Terms & Conditions

1. General

1.1 These Terms and Conditions (T&C) apply to all contracts concluded between the customer (hereinafter: CUSTOMER) and GARADOS, MWN Holding GmbH, Danziger Str. 122, 40670 Meerbusch, Germany (hereinafter: SELLER) through the online shop at garados-swim.com.

1.2 The presentation of products in the SELLER's online shop constitutes a non-binding invitation for the CUSTOMER to place an order. By submitting an order, the CUSTOMER makes a binding offer. The contract is only concluded when the SELLER accepts the order through shipment confirmation.

1.3 Only private individuals are considered CUSTOMERS under these terms.

2. Changes

The SELLER reserves the right to modify these terms if necessary. Changes will be communicated to CUSTOMERS and require their consent to become effective.

3. Order Process

3.1 The CUSTOMER adds products to the shopping cart and initiates the order process. Required shipping and payment details must be provided. Orders are binding upon clicking the "Buy" button.

3.2 Confirmation of order receipt will be sent automatically via email.

3.3 Orders exceeding quantities typical for private use may be rejected.

3.4 Input errors can be corrected during the order process using the browser's navigation tools.

3.5 The CUSTOMER acknowledges these T&C, the Privacy Policy, and the Right of Withdrawal when submitting an order.

3.6 Contract language is German.

4. Storage of Contract Text

The SELLER does not store the full contract text. The order details and T&C will be sent via email.

5. Right of Withdrawal

If the CUSTOMER is a consumer, they have the statutory right of withdrawal. Withdrawal instructions and a sample withdrawal form are available here: [Insert Link]

6. Exclusion or Expiry of the Right of Withdrawal

The right of withdrawal does not apply to:

Perishable goods.
Sealed goods unfit for return due to health or hygiene reasons once opened.
Customized goods made specifically to the CUSTOMER's specifications.

7. Return of Products

Returns should be made in original packaging with all components. The CUSTOMER is encouraged to use protective outer packaging and provide proof of return shipment.

8. Prices and Shipping Costs

8.1 Prices shown on the website at the time of order apply.

8.2 Prices include VAT.

8.3 Shipping costs are calculated during checkout and shown before order submission.

8.4 Return shipping within DACH is free; outside DACH, the CUSTOMER bears the return costs.

9. Payment Terms

The SELLER accepts the following payment methods:

Credit Card (Visa, Mastercard, Maestro)
Klarna Invoice
Klarna Sofort
Apple Pay

10. Promotional Coupons

10.1 Promotional vouchers cannot be purchased and are only valid during the specified campaign period.

10.2 They cannot be redeemed for cash.

10.3 Multiple vouchers cannot be combined unless explicitly allowed.

11. Gift Vouchers

11.1 Gift vouchers are non-transferable and cannot be redeemed for cash.

11.2 They must be entered at checkout to be valid.

12. Delivery and Shipping Terms

12.1 Delivery will be made to the address provided during the order process.

12.2 Delivery timelines will be specified on the product page.

12.3 Delays due to third-party shipping providers are not the SELLER's responsibility.

13. Refunds

Refunds will be processed using the original payment method used for the order.

14. Retention of Title

The SELLER retains ownership of goods until full payment has been made.

15. Warranty / Liability for Defects

The SELLER warrants that the goods will be free from material defects and delivered in pristine condition. The CUSTOMER is required to inspect the goods upon receipt and report any visible defects or insufficiencies within 14 days of delivery. If the product arrives damaged or defective, the SELLER will offer a replacement at no additional cost.

The SELLER does not assume liability for any damage or loss of items placed in the waterproof pocket, including but not limited to damage caused by unforeseeable circumstances, misuse, or unintended use of the swimwear.

If damage occurs after the product has been used, the CUSTOMER is encouraged to contact the SELLER's customer care team for further review. The SELLER will assess the case individually and determine an appropriate resolution at its discretion.

This warranty does not affect the CUSTOMER's statutory rights.

16. Customer Account

16.1 A CUSTOMER may create an account for easier order management.

16.2 Only one account per CUSTOMER is permitted.

17. Data Storage and Data Protection

Data handling is governed by the SELLER's Privacy Policy, available here: [Insert Link]

18. Dispute Resolution

The SELLER is not obligated to participate in dispute resolution procedures but complies with EU regulations.

19. Final Provisions

19.1 German law applies, excluding the UN Sales Convention.

19.2 Should any provision be invalid, the remaining provisions remain unaffected.
